By accessing H.C.A.'s family of websites, including Canadian Association for Integrative Nutrition (CAIN), The Holistic Entrepreneur Academy (HEA) and other CAIN or HCA owned websites, (collectively, "the Site(s)"), you agree to be bound by the terms and conditions described herein ("Terms of Use") and any subsequent changes, as it may be updated from time to time. Except as specifically stated otherwise, these Terms of Use set forth the entire understanding relating to this subject matter.
b. Severability. If any provision of the Terms of Use is held to be invalid or unenforceable by any law, rule, order, or regulation of any government or by the final determination of any jurisdiction, all remaining provisions hereof will remain in full force and effect.

Terms of Use for Members

Your membership renews automatically each year. We ask that you set a reminder for the renewal date each year in your calendar. While we do send an auto-reminder to each member on a subscription as a courtesy, we cannot guarantee the delivery of this email to your inbox. It is your responsibility to remember your payment dates and act accordingly.

Terms and Conditions for annual subscription: ** You are purchasing a one-year professional membership. For your convenience and to protect your membership from lapsing, your yearly membership will auto-renew in one year at the same annual rate.
By making your payment and submitting your application, you agree to be charged the annual fee each year for a minimum 12-month membership contract. If you decide to cancel your membership, you must complete the cancellation form a minimum of 48 hours prior to the payment being taken out in order to stop the auto-renewal payment from being processed.
If a renewal fee is missed and you have not cancelled your membership, HCA will assume you did not intend to miss a renewal fee and continue to attempt to take payment until such a time when your membership has been cancelled. Refunds of any kind are not available for renewing members once a payment has been taken.
New members applying for the first time may request a refund within 24 hours of payment, if you have not yet been granted access to the member area. A 25% processing fee will be applied to the refund. Refunds are not available for new members beyond the 24 hour period or if you have already been granted access to to the member area, whichever comes first.
Terms and Conditions for monthly subscription: Monthly subscriptions are not available to new members.
** Members who are on a monthly payment plan have agreed to purchasing a one-year professional membership split into 12 monthly payments. For your convenience and to protect your membership from lapsing, your yearly membership will auto-renew in one year at the same monthly rate.
By making your first payment and submitting this form, you agree to be charged the monthly fee for a minimum 12-month membership contract after which you can cancel prior to your yearly renewal date.
If you decide to cancel your professional membership after one year, you agree to complete the cancellation form a minimum of 2 days prior to your last payment being taken . Monthly 12 payment plan members cannot be cancelled until the 12 payment commitment has been fulfilled or you have paid off your dues for the current year.
If your monthly plan goes into the next year, you agree to pay for an additional 12 payment period.
As we no longer offer monthly payment plans, once it lapses, the payment plan option will no longer be available to you.
Member Registry Public Profile: When you are approved as a member of HCA, your information will be added to the public registry as follows: Full name, location (city, province / state and country), business name, designation awarded by HCA, your HCA registration number, date since and expiry date of membership, your member status (active or inactive), whether or not you have liability insurance and any formal compliants that were acted upon by HCA, if applicable (see complaints process for more details). These details are permanent in our registry and will not be removed.
HCA relies on its members to provide current and accurate information, and we do not, and cannot, investigate information contained in member public profiles beyond what is supplied to us by our members. It is solely the responsibility of the member to ensure they keep their information accurate and up to date. HCA does not represent, warrant or guarantee the accuracy of public profile information, and hereby disclaims all responsibility or liability for any information provided by members by means of public profiles or otherwise.
Member Perks & Discounted Benefits: Member perks, freebies and discount benefits are for the sole use of our members. They are not to be shared for any reason. Sharing the details for member discounts, freebies and services will result in suspension or termination of your membership. Member perks, freebies and discount benefits are for active members in good standing only. Should you terminate or lapse your membership, the benefits will cease to be available to you and notification will be sent out.
Account & Passwords: You are responsible for maintaining the confidentiality of your username and password, and you are responsible for all activities under your account that you can reasonably control. You may not share your password or other login information with any person; any use of your account by any person other than yourself is grounds for suspension or termination of your account. You agree to promptly notify us of any unauthorized use of your username, password or other account information, or of any other breach of security that you become aware of involving your account or the HCA Services. You agree not to use the account, username or password of any other account holder at any time. HCA will not be liable for any loss that you incur as a result of someone else using your password, either with or without your knowledge.
Safety Policy: Acts of violence or harassment against or by any employee or member will not be condoned or tolerated by the Health Coach Alliance. Both members and employees are responsible for adhering to this policy, and should report every incident of violence or harassment immediately to management. This includes any incidents that have been witnessed, experienced by, or reported to an employee.
Any disciplinary action will be determined by the Health Coach Alliance and will be proportional to the seriousness of the behaviour or action involved in the incident.
If the company determines that an employee or member has been involved in an incident of violence or harassment towards another employee or member, immediate disciplinary action will be taken, up to and including immediate dismissal.
Terms of Use for Schools and CE Course Reviews
By making payment, the Schools and Continuing Education Programs acknowledge that they are purchasing a review of their program. By making this purchase, it in no way guarantees approval of the program to be reviewed.
In order for HCA to complete the review process, full access to your program is required. If you are an online program, a username and password must be created. For physical programs, please provide transcripts and full copies of your program to be reviewed. If we cannnot view your full program, your application will be denied.Should your program not meet the requirements set forth in the HCA guide, you have one year from the date of application to submit all outstanding requirements to gain approval. Failure to do so within this timeframe will result in denial of your application. Should you wish to gain approval after the 12 month period, you must begin the application process again.

Refund Policy
Due to the nature of our business we are not able to provide refunds of any kind.
Members: A cancellation of your membership may be made as an exception within 24 hours and only if you have not already been granted access to the membership area. A 25% processing fee will be withheld from all cancellations within this timeframe.
Once you have been granted access or 24 hours has passed (whichever comes first), no cancellation or refund of your membership fee will be made.

Intellectual Property
Any unauthorized use of any material contained on the Sites or learning platforms may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations. HCA monitors the use of its intellectual property may seek legal action against any infringing parties.
HCA respects the rights of other copyright holders. If you believe your copyright is being infringed, HCA will respond to notices of alleged infringement.

HCA employs reasonable technical and organizational safeguards to protect your information, including encrypted and certified web sockets, multiple layers of security and passwords for live and development environments, obfuscation or deletion of data when transported from live sites to development sites, best practices for user management and security policy, constant updates via patches for known security flaws. Highly sensitive fields such as SSN, EIN, Credit Card and bank information are stored as encrypted and/or obfuscated strings, and are not wholly available via data connections over API, even via authenticated API.
When users submit sensitive information via the Sites, all information is protected both online and off-line. However, due to the nature of the Internet, HCA cannot completely ensure, guaranty, or warrant the security of any information transmitted to us or through our Sites or learning platforms. Submitting information is done at your own risk.
